There is no single Section 301 rate for all China goods

Section 301 treatment depends on the imported product's classification, origin, relevant action, and any valid exclusion. It is one layer of the US tariff assessment, not a universal all-in China import rate. A seller needs a product-specific calculation for the intended entry date.

USTR's February 2026 statement described existing China Section 301 rates ranging from 7.5% to 100%, depending on the product. That range is context, not a rate quotation for an unspecified item. Current entries must be checked against the applicable tariff provisions and notices.

Start with classification and origin

Prepare a technical description covering material, construction, functions, and use. Determine the ordinary HTS classification with a supportable basis. Searching for a low-duty description and then adapting the invoice to it reverses the proper process.

Establish country of origin separately. Purchasing from a supplier in China, shipping from China, and having China-origin goods are related but distinct facts. Repacking or transshipping through another country does not by itself create a different origin.

Retain the manufacturing facts used for the origin decision. If a multi-country production process creates uncertainty, seek qualified advice or an appropriate ruling before treating the goods as outside a China measure.

Check the current tariff and Chapter 99 treatment

Use the USITC tariff information and the relevant current schedule. Record the revision and entry date, then identify any additional Chapter 99 reporting and applicable notes. The rate shown beside a standard tariff line may not include all additional duties.

Separate Section 301 from ordinary duty, other trade measures, antidumping or countervailing duties where relevant, and fees. Do not combine different legal measures into one unexplained percentage. Their applicability, exclusions, and calculation rules can differ.

Ask the broker for a line-level calculation and the legal basis for each addition. A quotation saying only China tariff makes it difficult to verify whether the correct measure has been applied or whether something has been counted twice.

An exclusion needs both textual and timing support

Check the product description, tariff provision, and effective period of an exclusion. Sharing an HTS number with an excluded product may not be enough when the exclusion has additional descriptive limitations. Document how the actual goods satisfy those conditions.

USTR's exclusion index links the December 1, 2025 notice extending specified exclusions through November 9, 2026. Read the operative notice and precise entry timing rather than treating a broad press-release date as the whole rule.

An exclusion from a particular Section 301 duty does not necessarily remove ordinary duty or other applicable charges. Keep the saved amount separate in the cost model. Review the position again if the product specification changes or the shipment enters after the exclusion period.

Turn the assessment into a controlled pricing record

For each SKU, retain classification, origin, customs-value basis, additional provisions, exclusions considered, and provider confirmation. Identify which inputs are verified and which require a decision. Do not quote customers an all-inclusive delivered price from an unresolved classification.

Run a scenario for a relevant exclusion expiring or a supported product input changing. Label this as a planning scenario, not a prediction that a new tariff will occur. It helps determine whether the selling price can absorb uncertainty or needs a shorter quotation validity period.

After entry, reconcile the actual customs records and charges with the approved calculation. Investigate discrepancies while evidence is available. The practical protection against tariff mistakes is a dated, product-specific record that can be checked, updated, and explained without relying on yesterday's headline rate.
